- As part of the sale process the seller must supply the buyer with information about the property. The forms the seller needs to complete can be downloaded here. Sale Process
Whilst every transaction has its own unique features there is a general pattern which we set out below. As soon as a sale has been agreed, subject to contract, we will:
- Take instructions from you. This will incude such matters as: full names and addresses of all parties involved in the transaction; the location of the title deeds; the price; whether an initial deposit has been paid; the fixtures to be removed; anticipated completion date; who is resident at the property
- Obtain documents from you to prove your identity. Normally we need an original current signed passport and an official document verifying your address. For example a council tax bill or current utility bill. Proof of identiy is requirement in all cases to comply with: Anti Money - Laundering regulations, Land Registry regulations and as a precaution against mortgage fraud
- Prepare the contract and send it to the sellers' solicitors with the Home Information Pack
- Answer any additional enquiries raised by the buyer
- Check the financial position, including the amount needed to redeem any current mortgage on the property.
- Exchange contracts
- Answer requisitions on title raised by the buyer
- Approve the draft transfer
- Prepare a completion statement
- Obtain redemption statement from the lender
- Obtain sellers' signature to transfer
- Prepare undertaking to discharge the mortgage
- Make arrangements for completion
- Completion - receive the purchase price by telegraphic transfer and arrange release of the keys
- Discharge the sellers mortgage
- Pay estate agent's fee
Purchase Process
A normal purchase involves the following steps.
- Take instructions as to price and parties names and addresses etc
- Examine the pre - contract package and Home Information Pack
- Make additional searches if needed
- Check the title to the property
- Resolve any queries
- Return the draft contact to the seller
- Ensure that the buyer's mortgage or funds are in place
- Check the lender's instructions
- Report to the buyer on pre - contract investigations
- Send signed contract to the seller
- Check that insurance is in place
- Exchange contracts
- Raise requisitions on title
- Send the draft transfer to the seller
- Obtain buyer's signature to the transfer and mortgage deed
- Send signed transfer the seller
- Make pre - completion searches
- Report on title to the lender
- Prepare financial statement
- Obtain completion funds
- Make arrangements for completion
- Complete
- Pay Stamp Duty Land Tax
- Give notice of assignment of life policies etc
- Discharge the seller from undertaking
- Deal with registration of title at the Land Registry
- Deal with safe custody of deeds
